This agreement describes the terms and conditions that govern use of the of our 'for sale' service at www.ccpwa.com/forsale.htm governed by Chellington Pty Ltd, trading as Concert and Corporate Productions (CCP).
You must read and agree with all of the terms and conditions included in this agreement. By using the services of the site, for either buying or selling purposes, you accept and are bound by these terms and conditions. We may amend this agreement at any of which notice will be posted on our website.
Our services are only available to individuals who can form legally binding contracts under applicable law. If you do not qualify, do not use our service.
Unless otherwise agreed by all relevant parties, all discussions of the transaction are to be completed between the purchaser and the seller direct and CCP take no liability in the delivery of the goods from the seller to the purchaser. Both the purchaser and seller must proceed with the agreed transaction unless mutually agreed otherwise. Because user authentication on the Internet is difficult, CCP cannot confirm the integrity of the seller and urge any purchasers to establish efficient communication and agreements with any potential sellers. CCP is in no way liable for the follow through of the transaction between the buyer and any third parties and any disputes arising from this process. Because CCP is not involved in the transaction between buyers and third party sellers, in the event that you have a dispute with another user of the service, you release CCP from claims, demands, damages of every kind of nature arising out of or in any way connected with such disputes.
GOODS:
The goods as described and pictured on the site are the items to be sold. CCP is in no way liable for the service, quality or condition of equipment of third party suppliers advertising on the site. CCP will not be in any way liable for the quality or working order of the goods advertised by third parties on the site. We provide this service on an 'As Is' basis and without any warranty or condition. To the extent permitted by law, we disclaim any implied warranties of title, merchantability, fitness for a particular purpose and non-infringement.
CCP have the right to refuse or remove any item of sale from a third party from the site without notice. You must be legally able to sell the item(s) that you list for sale on our site. You must provide an accurate description of the item which may include photographs of the product you wish to sell. No person may manipulate or interfere with the price or description of another user's sale item.
In no event shall CCP be liable for lost profits or any special, incidental or coincidental damages arising out of connection with our site and our services or this agreement. You agree to accept the sole responsibility for the legality of your actions under the laws which apply to you. You agree that CCP have no responsibility for the legality of the actions of third parties using the services of the site.
You agree to indemnify and hold CCP, subsidiaries, affiliates, officers, directors and employees harmless from and against any claims, proceedings, demands, losses and damages of every kind made by any third party due to or arising out of breach of any of these terms and conditions or violation of any law or the rights of a third party.
You shall comply with all applicable domestic and common laws, statutes and regulations regarding use of this service. You alone, not CCP are responsible for confirming that your actions are complying with applicable laws. It is also your responsibility to ensure you comply with all clauses of this agreement.
You and CCP are independent contractors and no partnership, agencies, employee - employer or franchiser - franchisee relationship is intended or created by this agreement.
